Holiday Rental Terms & Conditions:
- All holiday rentals are to be booked by telephoning or emailing Turkey Beach N Bay Realty – during office hours: 8am – 5pm Monday to Friday. Weekends are flexible so if you ring and reach the message bank leave your name and number and I will get back to you next time I am in the office. Contact information is on the website.
- No bookings can be made on any of the calendars for the properties. These calendars are to assist you in planning your holiday. Once you have spoken with the agent, provided confirmation of agreement to terms and conditions and the booking deposit has been deposited into the agency’s trust account, then the calendar will be altered reflect your booking within 48 hours.
- You will be required to complete and sign a registration form – which will be sent to you by the agent, then either scan and email, post or hand deliver to the agency office.
- The return of the signed registration form indicates that you have read and agree to abide by these Terms & Conditions as well as The House Rules.
- This then creates a binding agreement between Turkey Beach N Bay Realty (herein referred to as the “Agent”) and the tenant named in the booking registration.
- The property is let for holiday / short term purposes only and specifically for the period stated on the registration form. NO weddings, parties or large gatherings are permitted without prior approval – in writing.
- Any type of approved function or large gathering will incur a minimum bond of $1000.00.
- A minimum of $100 deposit is required at the time of booking. This can be done by internet transfer, or credit card over the telephone.
- Once this deposit is paid the tenant understands and accepts that it is generally not refundable and the agent may use her discretion should a booking be cancelled and a refund requested.
- In the event of local flooding or natural disaster, then the deposit will either be retained for use for another booking or returned in full.
- Half of the balance needs to be paid at least two weeks prior to the start date with the balance of the total rent for that booking being paid on collection of the keys. EFTPOS facilities are available so contact the agent to arrange this service.
- At the time of key collection, you are required to present a credit / debit card against which a $200 Cleaning & Key Bond will be held. If there is damage, loss of property or filth (for example, fish offal in the rubbish bins – with or without maggots), all or part of the $200 will be kept for the purposes of repair/replacement/cleaning, at the agent’s discretion. Fish and shellfish are to be cleaned outside of the building only.
- If you use cash for the Cleaning & Key Bond, and the bond is not required for damage, loss of property or cleaning, then this will only be returned via internet transfer so you will need to provide your banking details to the agent for this to occur. This will be part of your registration information should you choose this method.
- All damage / breakages or loss of property and / or furniture are to be reported to the agent at your earliest convenience and no later than 24 hours from the event. The tenant will be responsible for damage to the premises or loss of or damage to any items in the premises and the tenant will pay to the agent the cost of replacement or repair (at the discretion of the agent) of any such item damaged or lost. $25.00 minimum charge applies.
- At no time is fish offal, prawn / crab shells and any other bait to be put into the rubbish bins of the rental property. You have several options here. The agent’s preferred method is for you to freeze any such rubbish and take it to the designated bin at the waste transfer station as you leave our village, or on a daily basis. You will find more information on this in your property’s compendium.
- If the property is sold, the agent cannot accept responsibility for the decision made by the new owner(s). Every reasonable endeavour will be made to offer alternative accommodation should this occur.
- In the event that the said premises become unavailable for occupancy through unforeseen circumstances (fire, storm damage, change of ownership, etc.) then the agent will inform the tenant immediately and endeavour to obtain suitable alternative premises for this tenancy; failing that, any monies paid are to be refunded to the tenant.
- It is the tenant’s responsibility to take out travel insurance to cover any unforeseen circumstances. Also all care but no responsibility is taken for tenant’s personal property left on the premises.
- Holiday letting keys are available for collection between 2pm and 5pm, Monday to Friday, on Saturday between 11am and 12midday. Early arrivals can be arranged, providing property availability and ample prior notice is given. The tenancy expires at 10am on the date of departure. Keys must be returned on the day of departure between 8am and 10am Monday to Saturday. If vacating outside these hours or on a public holiday, please contact the agent to arrange key drop off.
- Failure to depart before 10am or requests to take up tenancy prior to 12midday may incur an additional fee.
- All dishes and cutlery are to be washed, dried and stored prior to departure.
- Excluding infants (under 12 months of age), the number of persons staying at the property cannot exceed the total number of sleeping positions in the property. Generally this is a total of 6 – 8 – please see property descriptions for more information.
- Where applicable individual ‘House Rules’ shall be complied with.
- Noise is to be kept to a minimum. No person on the premises shall behave in a manner that is a nuisance to neighbours. Any person causing nuisance or annoyance to surrounding neighbours will incur immediate termination of the booking. The agent cannot be held responsible or liable in any way for noise or disturbances created outside the property by local residents, workmen, etc., and no discounts will be negotiated.
- Pets are NOT permitted on the premises without prior arrangement.
- No responsibility is taken by the property owner or the agent for power failure resulting from service provider failing to provide power for any reason whatsoever.
- No responsibility is taken by the owner or agent for misuse or failure of appliances during the rental tenancy for any reason whatsoever. All reasonable effort will be undertaken, by the agent to repair or replace any such items as soon as practical. Please notify the agent during your stay if any item requires maintenance.
- The tenant will permit the agent and/or persons authorized by the agent, to enter the premises during the term for the purposes of necessary repairs and investigation of complaints. The agent will give due regard to the tenant’s right to quiet enjoyment.
- Bookings are not transferrable and (with telephone or internet bookings) the description and photographs of the property are made in good faith but no responsibility for mis-description can be accepted. Holiday Property Owners may replace, change or remove items without prior notice.
- Bookings are made in good afith by the agent and tariffs quoted are correct at the time of printing and are subject to change without notice.
